Subject: Restraint and Seclusion Legislation

Hello PENT Cadre and Supporters,

You may have heard, there are two proposed bills that have been introduced at the Federal level regarding restraint and seclusion in schools. They are: H.R. 4247, Preventing Harmful Restraint and Seclusion in Schools Act, introduced by Chairman Miller (D-CA) and Representative McMorris-Rodgers (R-WA), and the companion bill, S. 2860, introduced by Senator Dodd (D-CT). Many organizations are weighing in on these bills. Some of the key issues are:
• Clarifying the definition of key terms such as imminent danger;
• Banning “planned” physical intervention, but allowing “potential” physical intervention to be written into IEPs and BSPs;
• Training school staff to use appropriate restraint and seclusion
