Subject: PENT Update on AB 3632
Greetings Cadre members, SELPA Directors, and supporters,
I promised to keep you updated on the status of mental health services to special education.
First, there is bad news. Governor Schwarzenegger’s repeal of the state mandated funding is still in place. This means that County Mental Health bears the total financial burden for any AB3632 services. Since they are no longer reimbursed by the state many are refusing to provide services and the SELPAs have to pick up the slack. There are three laws suits in place to overturn the repeal and get AB3632 back on track. However to date no decisions have been made.
Second, there is good news. Governor Brown has reinstated the funding for the 2011-12 fiscal year budget. However, when funded there will be limitations on counties regarding spending requiring them to stay within their budget. In the past, they could see as many students as they wanted and the state would reimburse for all expenditures even if they were over the allocated amount.
Finally, our new State Superintendent of Public Instruction Tom Torlakson and many of the SELPA leaders are closely monitoring this to develop plans for the future to ensure that the proper services are provided.
